"Chinese People's Criminal Law Preference Research"

Introduction: The people's preference for heavier or lighter criminal law, and how to deal with the relationship between criminal law and public opinion is a problem that the criminal rule of law cannot avoid. This study is based on the CFPS project of Peking University. The empirical study with more than 30,000 samples as the source of data found that: First, the Chinese people's criminal law preference coefficient is lower than the middle line between 0 and 1, which is 0.36, indicating the large sample study. The evidence does not support the Chinese people's general preference for heavy law. Second, the traditional crime victimization has no significant impact on criminal law preferences. Criminal law preference is a distorted reflection of various social factors. The conclusion is that the case law related to criminal law should be highly cautious and calm, with limited response to criminal law preferences, and be wary of the excessive socialization of criminal law and the "inflation" tendency of criminal law resources.
